NEC3: New Engineering Contract

Date: 21 - 22 JUNE 2017

The course will look at NEC – ECC core clauses, main and secondary options, contract strategy and structure from the perspective of Contractor and Subcontractor appointment. The course will also deal with change management systems, dealing with variations and extensions of time. It will look at common changes made by Employers to the Conditions of Contract through the Z clauses and their impact and particular reference to limitations of liability and force majeure.

The course will also focus on the NEC3 – Short Contract strategy from the perspective of Contractor and Subcontractor. Thereafter the course will deal with the Early Warning and Compensation Events requirement and understanding of notifying Early Warnings and Compensation Events by the Contractor and Employer. The seminar will also highlight the Project Manager, Supervisor and Adjudicator’s authority regarding the responsibility dealing with Contractors. Risk Register requirements of the Employer and Contractor at the tender and during the contract stage are explained. Case studies are discussed to apply the learning of the course syllabus encouraging participation of all delegates.

FIDIC Contracts – A Practical Approach

Induna in Partnership with FIDIC are hosting this two day programme, which is facilitated by Kevin Spence, and based on the FIDIC Approved Module 1 Workshop and introduces the FIDIC Suite of Contracts.

This two day programme examines the roles of both the Employer and the Engineer and highlights the essential differences between the various contract documents. The responsibility for design is dealt with and a substantial amount of time is devoted to the issue of extensions of time, variations and certification. Dispute resolution under the FIDIC Contracts is highlighted and the issues of notices, claims and time bars are discussed in detail.

This practical course is supplemented by true life case studies and group discussions ensure that delegates come away with a good understanding of the FIDIC philosophy.
