NEC3: New Engineering Contract

Venue: COUNTRY CLUB JOHANNESBURG WOODMEAD

The course will look at NEC – ECC core clauses, main and secondary options, contract strategy and structure from the perspective of Contractor and Subcontractor appointment. The course will also deal with change management systems, dealing with variations and extensions of time. It will look at common changes made by Employers to the Conditions of Contract through the Z clauses and their impact and particular reference to limitations of liability and force majeure.

The course will also focus on the NEC3 – Short Contract strategy from the perspective of Contractor and Subcontractor. Thereafter the course will deal with the Early Warning and Compensation Events requirement and understanding of notifying Early Warnings and Compensation Events by the Contractor and Employer. The seminar will also highlight the Project Manager, Supervisor and Adjudicator’s authority regarding the responsibility dealing with Contractors. Risk Register requirements of the Employer and Contractor at the tender and during the contract stage are explained. Case studies are discussed to apply the learning of the course syllabus encouraging participation of all delegates.

Understanding DABS

Understanding DABs: Enabling parties, their representatives, Engineers and Dispute Board members to understand and manage the DAB process.

This two day interactive workshop will be facilitated by Kevin Spence, Accredited FIDIC Trainer and Admitted Adjudicator to the FIDIC Presidents List.

Over the last 10 years Kevin has been involved as Mediator, Adjudicator, Arbitrator and expert witness on approximately 60 dispute matters. He is presently appointed on Dispute Adjudication Boards (DAB) in numerous matters in and out of South Africa. The first day will be spent covering DAB’s and the second day will cover true life mock DAB’s. Interactive case studies will take place throughout the workshop.
